The WHMIS legislation provides that workers must be informed about the hazards in the workplace and receive appropriate training to enable them to work safely. To accomplish this, WHMIS delivers the necessary information by means of:
- WHMIS labels on controlled products
- Material Safety Data Sheets (MSDS)
- WHMIS education and training
All employees must have this training when they start working for a new employer. The ultimate goal is to create a safer workplace by providing workers with the knowledge and tools to enable them to work safely.
Federal and Provincial Regulations (Canada Labour Code Part Two and Workers’ Compensation Board Regulations) must be 100% in compliance whenever hazardous materials or controlled products are used in the workplace. A Federal Law passed in March 2004, now makes Executive Officers, Company Owners, Managers and even Shift Supervisors accountable for the actions of their employees!
Bill C 45 amends the Criminal Code to clearly define who is responsible for the safety of persons in the workplace, and to allow for prosecution under charges of “Criminal Negligence” when those responsibilities are disregarded. This requirement applies, in addition to existing health and safety legislation, to both federally and provincially regulated workplaces. Charges under Bill C45 could result in penalties in the millions of dollars or a jail term, for those found guilty, of up to life imprisonment!
